#1529              Davis, Laura                                      38 N. Main Street

Applicant seeks two findings and a special permit relative to proposed garage expansion to a structure on a nonconforming lot.  Property is located at 38 N. Main St. and is situated in the Historic District 1 within the Groundwater Protection District.

Board of Health letter dated 05/25/05 read. Stating no objection

Conservation Commission letter dated 05/23/05 read.  They recommend that this permit not be issued without nitrate/nitrogen removal.

 

Historical Commission letter dated 05/23/05 read.  Stating the property is located in the Historical District and a Public hearing will be held on June 8.  They suggest that any decision on the Boards part should not be made until after this meeting is held.

 

Applicant describes plans for a two-story addition on the right side of the house.  On the first floor addition a open area office will be off the vestibule which enters into the existing family room.  There will be a deck off the office.  Off of the office will be a storage and a two car garage.  On the second floor the master bathroom will be enlarged, a vestibule and a roof deck will be added.  The driveway on the left side will be removed

 

Sharon resident, N. Main St.  Have concerns with visual aspects of the project within the Historical District.

 

Walter suggests that Applicant and neighbors should discuss their  concerns.

The Board suggests that the Applicant speak with Greg Meister regarding his conservation issues.

Applicant seek two findings and a special permit relative to proposed expansion on a nonconforming lot.  Property is located at 6 Worcester Rd. and is situated in the Single Residence B Zone within the Groundwater District.

Applicant describes plans to add a 12 by 16 family room off the dining room.  A new 12 by 14 deck will be added off the family room.

 

Existing living space 1250 sq. ft and proposed living space 160 sq. ft.

Applicants seeks a variance from the minimum side and rear lot lines as well as any findings, variances, of special permits which the Zoning Board determines requisite for this matter.  Property is located at 53 Bradford Ave. and is situated in the General Residence Zoning District.

Conservation Commission letter dated 05/24/05 read. Stating no objections.

 

Correspondence from Joseph Kent, advising that the property has been incorrectly identified on a public notice as situated in the General Residence zoning district.  Instead, 53 Bradford Avenue is currently situated in the Single Residence B Zoning District.

 

Attorney Joel Fishman, representing the Applicants, reviewed the history of the matter.  Mr. Fishman indicated that during attempted mortgage re-finance it was discovered that the house was less than 20 feet from a jog in one of the sidelines..  Applicant is seeking a variance from minimum setback from side or rear lot lines,

 

Mr. Reed from Toomey of Toomey-Munson & Associates, Inc, explained the history of the parcel.  Mr. Reed indicated that there was a DPW request for an adjustment of a jog..  Apparently there was a mistake in plans at the land court and the problem was not caught until there was a review of plans for a mortgage refinance.  The corner of the screened in porch is 16.2 feet from the lot line.

 

There was discussion on possible explanations for how this happened.

 

John made motion to approve variance from Sharon Zoning By-Law sec. 2434b noting substantial hardship.
